SINGLE FAMILY DWELLING

The Meadows at Rexburg is zoned as High Density Single Family Dwelling by the City of Rexburg. We are also classified as the same in the CC&Rs of the Home Owners Association. Because of this, the following rules apply:

Definition of Family and Household

To maintain the residential character of our community and to comply with City ordinance, each dwelling unit shall be occupied as a single-family residence. For the purposes of these rules, a "Family" is defined as one or more persons occupying a single dwelling unit and living together as a single, nonprofit housekeeping unit. To qualify under this definition, the group must meet at least one of the following criteria:

  • At least one member of the group is related to all other members within the third degree of kinship (including parents, siblings, grandparents, grandchildren, aunts, uncles, or first cousins);
  • The group consists of two subgroups, where each member is related to others in their respective subgroup within the third degree of kinship; or
  • The residents are protected under the Idaho Code or the Fair Housing Act as handicapped or disabled persons.

Prohibition of Room Rentals and Boarding Houses

The practice of renting, leasing, or subletting individual rooms within a dwelling unit is strictly prohibited. A dwelling unit may only be leased or rented in its entirety to a single household. Homeowners are prohibited from entering into multiple separate leases for a single unit or operating the property as a boarding house, "rent-by-the-room" facility, or any other multi-tenant arrangement where the residents do not function as a single, integrated housekeeping unit.

Leasing Requirements

Any lease or rental agreement must be in writing and must cover the entire dwelling unit for the entire term of the lease. All tenants must be listed on a single lease agreement. Homeowners remain responsible for ensuring that all tenants comply with the Association’s governing documents, including these occupancy and leasing restrictions.

This rule was established under the 2009 version of the CC&Rs and has continued through to the creation of this website and the updating of this article.
